The rules and conditions for using flavir.co.

Welcome to Flavir. These Terms of Service ("Terms") govern your use of the website at flavir.co (the "Site") operated by Flavir Technologies LLC ("Flavir," "we," "our," or "us"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

These Terms apply to general visitors of the Site. If you become a Flavir merchant customer, your relationship with Flavir is also governed by a separate Merchant Service Agreement that takes precedence over these Terms with respect to the Services.

1. Use of the Site

You may use the Site for lawful, personal, and business purposes only. You agree not to:

Use the Site in any way that violates applicable law or regulation
Attempt to gain unauthorized access to any portion of the Site or related systems
Interfere with the security or proper functioning of the Site
Scrape, harvest, or collect information from the Site by automated means without permission
Impersonate any person or entity or misrepresent your affiliation
Use the Site to transmit malware, spam, or other harmful content

2. Demo Content and Examples

The Site may contain demonstrations, sample restaurants, mock data, and illustrative pricing intended to show how Flavir's services work. Demo content is for illustrative purposes only and does not represent any actual customer, real menu, real pricing, or live service. Any business names, logos, or imagery shown in demo content are either property of Flavir or used for illustrative purposes with permission, and should not be construed as endorsements.

3. Intellectual Property

All content on the Site — including text, graphics, logos, images, software, and design — is the property of Flavir or its licensors and is protected by intellectual property laws. The Flavir name, logo, and tagline ("Sweet Tech. Spicy Results.") are trademarks of Flavir Technologies LLC.

You may view and share content from the Site for personal, non-commercial reference. You may not copy, modify, distribute, sell, or commercially exploit any portion of the Site without our prior written consent.

4. Forms and Information You Submit

The Site includes contact forms, demo intake forms, booking pages, and similar tools. By submitting information through these forms you represent that the information is accurate and that you have the right to provide it. We use submitted information consistent with our Privacy Policy.

5. Links to Third-Party Sites

The Site may link to third-party websites or services (such as Calendly, payment processors, or social media platforms). We do not control these third-party sites and are not responsible for their content, terms, or practices. Your use of third-party sites is at your own risk and subject to their own terms.

6. No Warranty

The Site and all content on it are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, Flavir disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components.

7. Limitation of Liability

To the fullest extent permitted by law, Flavir and its officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of the Site — even if Flavir has been advised of the possibility of such damages.

Where liability cannot be excluded by law, Flavir's total cumulative liability arising from or related to the Site is limited to one hundred US dollars ($100).

Merchant customers' liability and indemnification terms are addressed separately in the Merchant Service Agreement, not these Site Terms.

8. Indemnification

You agree to defend, indemnify, and hold harmless Flavir and its officers, employees, agents, and partners from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.

9. Changes to the Site or Terms

We may modify, suspend, or discontinue any part of the Site at any time without notice. We may also update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Flavir regarding your use of the Site and supersede any prior or contemporaneous understandings on that subject.
